CATASTROPHIC INJURY

New York Catastrophic Injury Lawyer

A catastrophic injury changes the terms of everyday life. Medical treatment, work, independence, and family responsibilities can all change at once. A serious claim must account for that full picture, with evidence that explains both what happened and what the injured person now faces.

Lindenfeld Law represents people and families in substantial injury and wrongful-death litigation. Eric Lindenfeld’s prior experience includes representing an individual rendered paraplegic in a truck collision, an individual severely burned by a consumer product, and people catastrophically injured in collisions and falls. We bring close attention to the person, the medical record, and the conduct behind the harm.

The work

The matters we handle.

Serious collisions

Truck and vehicle collisions can leave permanent injuries and contested accounts of responsibility. We examine the events leading to the collision, the available physical and documentary evidence, and the medical consequences. The investigation must connect a clear account of responsibility with a complete account of the injury.

Dangerous products

A product-related injury can require investigation beyond the immediate accident. How was the product designed, marketed, and used? What did the company know? Our experience in product litigation informs how we examine company records, technical evidence, warnings, and the relationship between the product and the injury.

Falls and unsafe conditions

A serious fall requires careful attention to the condition of the property, how the incident occurred, and the evidence available from witnesses and records. We investigate the circumstances rather than assuming that the severity of an injury, by itself, explains who should be held responsible.

The full consequences

A claim should reflect more than the first hospital bill. Ongoing treatment, rehabilitation, assistance at home, lost earnings, and the loss of independence may shape the case. We work to make those consequences concrete, including the ways an injury affects a person’s family and daily life.

Our approach

Build the case around the life that changed.

Eric personally directs the litigation. We organize the accident evidence and medical history together, identify the questions that need technical or medical analysis, and prepare a narrative that people outside the case can understand. Complex evidence becomes useful when it explains a real person’s experience clearly and accurately.

The strategy should also fit the client’s circumstances. We discuss the work a case requires, the uncertainties, and an appropriate fee arrangement. As the record develops, we assess both opportunities for resolution and the preparation needed to present the claim at trial.

Questions

Before the
first conversation.

What information is useful for an initial conversation?

A short account of the incident, available photographs, reports, and a summary of the injuries are useful starting points. Information about treatment, work, and any communications with insurers can help us understand the situation. You do not need to assemble a complete case file before contacting us.

How is a catastrophic-injury case different from medical malpractice?

This practice focuses on serious injuries arising from collisions, products, falls, and other incidents. Medical-malpractice claims focus on allegedly negligent healthcare. Some situations raise both kinds of questions; the underlying events determine which issues need investigation.

Can a substantial injury claim be handled on contingency?

We consider contingency arrangements for substantial plaintiff claims. The structure depends on the case and is discussed before an engagement. Any agreement should clearly explain attorney fees, litigation expenses, and the client’s obligations.
